Go4.co.uk - Competition Terms of Service
PLEASE READ THESE OFFICIAL TERMS OF SERVICE CAREFULLY. THIS IS A BINDING CONTRACT BETWEEN YOU AND THE PROMOTER (SEE CLAUSE 1). THESE TERMS OF SERVICE MAY CHANGE FROM TIME TO TIME (SUBJECT TO CLAUSE 18.4, BELOW).
1. The Promoter
Go4 Competitions Ltd, a company registered in England & Wales with Company No. 14488986 (herein referred to as the ‘Promoter’, ‘we’, ‘our(s)’) specialises in organising and managing a diverse range of competitions and sweepstakes (‘Competition(s)’), catering to numerous interests and demographics.
Our Competitions are open to anyone in the United Kingdom and the Republic or Ireland who is aged 18 or over. Competitions result in the distribution of prizes (‘Prize(s)’) to the winners (‘Prize Winner(s)’), subject to the specific provisions and exceptions as outlined below.
2. Summary
- Variety of Competitions: We offer a broad spectrum of Competitions, including exclusive one-off Prize Competitions and exciting Instant Win Prizes.
- Charitable Donations A portion of the funds raised through each Competition will be used to support featured non-profit(s) and/or charitable causes (each a 'Charity’).
- Simultaneous Competitions: Multiple Competitions may be active concurrently, each uniquely designed with specific Prizes and themes to enhance participant engagement.
- Entry Options: Participants have the flexibility of choosing between free and paid entry (‘Entry’) routes for each Competition. The free Entry option is crucial in ensuring our compliance with the Gambling Act 2005, enabling us to operate legally in United Kingdom without requiring a gambling licence.
- Duration and Closure: Each Competition is bounded by a set timeframe, clearly detailed on our website (the ‘Website’) at https://www.go4.co.uk. Check each Competition on the Website for details of start and end times and dates (‘Promotion Period(s)’). The Promoter reserves the right to conclude Competitions earlier if necessary, in response to various operational or strategic considerations.
- No purchase necessary: No purchase, payment, or donation of any kind is necessary to enter or win. All Entries into a Competition have an equal chance of winning.
3. Eligibility and Undertaking
- Eligibility: Our Competitions are open to individuals aged 18 or over and who are based in either the United Kingdom or the Republic of Ireland, with the exception of employees, family members, or close associates of the Promoter, ensuring fairness and impartiality.
- Entry Agreement: By entering a Competition, participants affirm their:
- Legal capacity and eligibility to participate in such activities.
- Full acceptance of these comprehensive Terms of Service.
- Adherence and compliance with their local laws and regulations regarding participation in such Competitions.
- Promoter's Discretion on Entry: The Promoter reserves the right to exercise discretion over participation in our Competitions. We hold the authority to reject an Entry to any individual when deemed necessary, based on reasonable and lawful considerations.
- Jurisdiction and Legal Governance: All Competitions are governed under the laws of England & Wales, and any disputes arising will be subject to the exclusive jurisdiction of the courts of England (see Section 18).
4. Detailed Entry Procedures
4.1 Registration and Entry Process
To participate in any Competition, individuals must first complete a registration process on our Website. This involves providing a valid email address or linking a social media account (such as Facebook, Twitter, or Gmail). Post-registration, participants can enter Competitions by either:
- Submitting the Entry form on our Website ('Online Entry'); or
- Sending a Entry via post ('Postal Entry') to the Promoter's designated address, ensuring it arrives within the specified Promotion Period of the respective Competition.
4.2 Comprehensive Contact Information Requirements
Participants are required to provide detailed contact information, including:
- Full legal name
- Accurate date of birth
- Active email address
- Current postal address
- Reliable contact telephone number
This information is essential for verifying Entries, notifying Prize Winners and publishing winner details on our Website, and other uses as outlined in our Privacy Policy.
4.3 About Online Entry
For online Competition participation:
- Select your desired Competition on our Website.
- Proceed to purchase your Entry(s) for the Competition.
- During this process, you will be prompted to provide your contact and payment details.
- It is imperative to review your details for accuracy and to acknowledge the declaration, confirming your understanding and acceptance of the Competition Terms of Service.
- Upon successful purchase and clearance of your payment, we will send a confirmation email, securing your Entry into the Competition.
4.4 About Postal Entry
While the act of entering a Competition via Postal Entry does not incur a direct fee from the Promoter, participants should be aware of the associated postage costs. This method is an alternative to the Online Entry route and involves the following steps:
- Competition Specification: Clearly specify the particular Competition you wish to enter in your postal submission.
- Contact Details: Provide all necessary contact details as part of your Entry.
- Postal Address: Send your Entry to Go4 Competitions Ltd, Platt Barn, Bullen Farm, TONBRIDGE, Kent, TN12 5LX, United Kingdom.
- Postage Requirement: Each Postal Entry must be sent with appropriate first or second-class postage. Participants must bear this postage cost, which is non-refundable.
- Single Entry per Envelope: Bulk Entries in a single envelope will not be accepted. Each Entry must be mailed individually.
- Entry Limit: There is a limit of one Postal Entry per Competition for each registered account, with a maximum of one Postal Entry per person for each Competition.
- Equal Winning Chance: Each Postal Entry is treated with the same level of opportunity to win a Prize or an Instant Win Prize as an Online Entry.
This Postal Entry method provides an accessible alternative to online participation, ensuring compliance with legal requirements and offering participants a fair chance at winning, albeit with the associated postal cost.
4.5 Entry Deadline Compliance
All Entries, whether submitted online or via post, must be received by the Promoter by the end of the specified Promotion Period for the Competition in question. Postal Entries will be assigned random numbers and will be treated with equal consideration as Online Entries in the Competition. Any Postal Entries received after the specified Promotion Period for the Competition will not be eligible for entry. In such cases, the postage costs incurred for these late Entries are non-refundable
4.6 Official Entry Confirmation
An Entry is officially acknowledged and confirmed only after our explicit acknowledgement. This confirmation will be visible in the participant's account or may be communicated via email.
4.7 Promoter's Right to Refuse Entry
We reserve the right to refuse any Entry or to disqualify any Entry that is incomplete, inelligible, damaged or does not meet our criteria, based on reasonable and lawful grounds.
4.8 Grounds for Disqualification
Disqualification of an Entry is a measure we take very seriously and only in extreme circumstances. It occurs if there is compelling evidence suggesting a participant's conduct grossly violates the spirit of the Competition. This includes, but is not limited to, instances of clearly abusive, defamatory, or blatantly unethical behaviour. The Promoter will only resort to this step only when absolutely necessary and when the conduct in question is significantly detrimental to the integrity of the Competition or the experience of other participants.
4.9 Refund Policy
All Entries are considered final upon submission, and no refunds will be issued. A portion of each Entry is donated to Charity, supporting their impactful work. Therefore, once a Competition has closed, we are unable to offer refunds. All Entries, once submitted, become the property of the Promoter and become a part of the Competition's structure, contributing to the determination of the Prizer Winner(s) and the overall management of the Competition.
4.10 Postal Entry Processing
We use an external third party to process Postal Entries, who do so on a daily basis. Once a Competition is fully subscribed or sold out, no further Entries will be accepted. By sending a Postal Entry, you agree to be bound by any further terms and conditions set by the third party.
4.11 Specific Limits on Competition Entry
Each participant is permitted to enter a Competition up to the maximum number of Entries as stated on the Website. It is important to note that for each Competition, we allow only one free Postal Entry per individual. In addition, every Entry submitted by a participant to an Instant Win Competition, regardless of the method, automatically qualifies them for any Instant Win Prizes associated with that specific Competition.
In the event that a participant has attempted to circumvent these Entry limits by creating multiple accounts or using other means to exceed the maximum number of Entries allowed, we reserve the right to take strict action. This includes the immediate ban of the participant from future Competitions and the forfeiture of any Entries made in violation of this limit. Please be aware that in such cases of disqualification for excessive entries, no refunds will be provided for the Entries made. This policy is in place to ensure fairness and integrity in our Competitions.
4.12 Defined Range for Competition Entries
Each Competition has a defined minimum and maximum number of Entries. The Competition will close either when the last available number is taken or when the allocated timer runs out, whichever occurs first.
4.13 Eligibility for Instant Win Prizes
Once a participant's Entry is confirmed and their chosen combination is finalised, their Entry becomes eligible for any associated Instant Win Prizes, provided that the winning combination matches their selection.
5. Competition Judgement
5.1 Selection Process
As part of our commitment to fairness and transparency, we use a true Random Number Generator (RNG) for determining the winner of each Competition’s Prize. This sophisticated RNG system ensures absolute randomness in the selection process, corresponding to the total number of Entries in a Competition. This state-of-the-art method not only guarantees the integrity of our selection process but also aligns with our dedication to modern, reliable practices in Prize allocation. Additionally, in certain situations and at the Promoter's sole discretion, other verified random methods may be employed for selecting the Prize Winner.
5.2 Winner Types
The decision of the Promoter is final and no correspondence or discussion will be entered into.
For regular Competitions, there is typically only one main Prize Winner, unless we specify otherwise on the Website. However, this does not limit the scope of winning opportunities: additionally, there is the possibility of Instant Win Prize Winners, a concept elaborated upon in the following clause (5.3).
5.3 Instant Win Prizes
For all Instant Win Prizes within a Competition, the winning numbers are pre-selected in a veil of secrecy, just before the Competition goes live. These numbers are securely encrypted in our database and remain hidden from all staff members at the Promoter, ensuring the utmost fairness and integrity in the selection process.
5.4 Contacting Winners
The Promoter takes on the responsibility of attempting to contact Winners of Competitions and Instant Win Prizes using the Contact Details provided at the time of Entry or as subsequently updated. These details are held securely in our Database. We urge all Entrants to meticulously check and ensure their Contact Details are recorded accurately. It is the Entrant’s responsibility to ensure that these Contact Details are current, complete, and correct. If, for any reason, the Contact Details are inaccurately recorded by the Entrant, the Promoter will not bear any responsibility for any consequences arising from such errors.
5.5 Unreachable Prize Winners
If for any reason, the Promoter is unable to contact a Prize Winner within five (5) working days (a period which may be extended at the Promoter's discretion) of the end of a Competition, or if the Prize Winner fails to confirm acceptance of the Prize for whatever reason, or is disqualified due to non-compliance or contravention of these Terms of Service, the Prize Winner is deemed to have irrevocably and automatically forfeited the Prize. In such an event, the Prize remains under the possession and ownership of the Promoter.
5.6 Marketing Communications
Entrants who provide specific consent to receive marketing communications will be included on the Promoter’s database. This inclusion is for the purpose of conveying information about the status of their Competition Entry, as well as to inform about future promotions or Competitions offered by the Promoter.
5.7 Timing of Competitions
The Promoter will conduct the draw for each Competition at the end of the Promotion Period as stated on the Website for that specific Competition. There will be no extensions to the Promotion Period. All Prizes will be awarded in full, irrespective of the number of Entries for a Competition. The Promoter reserves the right to bring the draw date forward if the maximum number of Entries is received. In cases where a Competition is closed early, the Prize Winner will be selected from all valid and eligible Entries received by the Promoter prior to the date of closure.
5.8 Instant Win Competitions
For each Competition containing Instant Win Prizes, the Promoter will draw an Instant Win Prize winner during the Promotion Period as specified on the Website. There will be no Instant Win Prizes to be won post the Promotion Period. All Instant Win Prizes will be awarded in full, regardless of the number of Entries for a Competition.
5.9 Cancellation of Competitions
The Promoter reserves the right to cancel any Competition at any time, either before or after Entries have been sold. If a Competition is cancelled, the Promoter will notify each Entrant at the email address provided and return any payment made by an Entrant using the same method as the original payment, or offer a game credit to enable them to replay equivalent Entries in a subsequent Competition. Upon such a refund, the Promoter will have no further liability to the Entrant or any other person.
6. Cash Out Feature
6.1 Cash Out: Introduction
We offer a 'Cash Out' feature on our Website, allowing Entrants the flexibility to withdraw a portion of their Entry in a Competition before its conclusion. This feature is designed to provide participants with an additional option to manage their involvement in our Competitions.
6.2 Cash Out Conditions
- Partial Withdrawal: Participants can choose to Cash Out part of their Entry amount. However, it is important to note that the amount receivable through Cash Out may be less than the original Entry.
- Odds Consideration: The value of the Cash Out is influenced by the odds at the time of Cash Out. If the odds have lengthened since the time of the initial Entry, the Cash Out amount offered will be lower.
- Voluntary Decision: Opting for Cash Out is entirely at the participant's discretion. Participants should consider their decision carefully, understanding that the returned amount may be less than their total input, especially in scenarios where the odds have become less favourable.
- Cash Out Request: Participants can request a Cash Out through their account on the website.
- Availability and Restrictions: The availability of the Cash Out option is subject to specific conditions and may not be available for all users. The Promoter reserves the right to restrict or modify the availability of this feature at any time.
7. Online Chat
The online chat ('Chatbox') feature on our Website is offered on as "as is" basis and is governed by specific conduct guidelines to ensure a respectful and constructive community environment. Adherence to these guidelines is crucial for maintaining the quality of interaction and the overall user experience on our platform.
7.1 Guidelines for User Interaction
- Respectful Communication: All Participants are required to engage with each other in a manner that is respectful, courteous, and professional. The use of overtly offensive, abusive, or defamatory language is strictly prohibited.
- Privacy and Confidentiality: Participants must respect the privacy and confidentiality of fellow participants. The exchange or disclosure of personal information, including but not limited to contact details, within the Chatbox is not permitted.
7.2 Enforcement and Compliance
- Monitoring and Moderation: The Promoter reserves the right to monitor and moderate the Chatbox to ensure compliance with these guidelines. This includes the ability to remove any content or comments that violate the stipulated conduct.
- Consequences of Non-Compliance: Participants found in breach of these guidelines may face consequences including, but not limited to, temporary suspension of Chatbox access, permanent ban from the Chatbox, or in severe cases, disqualification from the Competition.
- Reporting Mechanism: Participants are encouraged to report any observed violations of these guidelines to the Promoter for prompt action.
8. Prize Winner’s Details
8.1 Proof of Age and Identification
Participants must be 18 years old or older to enter a Competition. This age requirement must be fulfilled at the point of Entry, not at the point of winning or Prize allocation. Prize Winners may, under certain special circumstances, be requested to provide documentary proof of their age and identification before receiving their Prize. This requirement is typically invoked if there is any reason for the Promoter to suspect that the age eligibility criteria may not have been met. In such cases, failure to provide satisfactory documentation could lead to disqualification, and the Promoter may then choose to reallocate the Prize.
8.2 Participation in Marketing
Prize Winners may be invited to participate in promotional activities, which could include providing photographs, posing for photographs, or appearing in videos. Additionally, there may be occasions where the Promoter requests to feature the Prize Winners' personal details, along with information about the Prize they've won, in marketing and public relations materials related to the Competition.
8.3 Prize Delivery Process
Following the receipt and verification of the requested details by the Promoter and provided the Prize Winner has complied with these Terms of Service, arrangements will be made to deliver the Prize to the Prize Winner.
9. Competition Prizes
9.1 Prize Selection and Ownership
The Prizes are meticulously selected by the Promoter. They are either owned by the Promoter or purchased from the date the Competition goes live on the Website until the Prize Winner receives the Prize. Detailed information about each Prize is available on the Website on the Competitions pages. The Promoter relinquishes responsibility for the Prize post-delivery to the Prize Winner. Once the Prize Winner has taken possession of the Prize, the Promoter is no longer responsible for insuring the Prize, and no insurance is provided with the Prizes.
9.2 Delivery of the Prize
Delivery of the Prize to the Prize Winner’s home address in the mainland United Kingdom is complimentary. However, the Promoter reserves the right to charge delivery fees if the Prize Winner requests delivery to an address outside mainland United Kingdom. All Prize Winners, irrespective of their location, have the option to elect a cash alternative to the Prize.
9.3 Prize Collection Expenses
All expenses incurred by the Prize Winner in collecting the Prize are the sole responsibility of the Prize Winner. Additionally, the Prize Winner is responsible for all taxes, duties, or charges related to the receipt of the Prize.
9.4 Prize Terms of Service
The Prize Winner hereby acknowledges that all Prizes are subject to the Terms of Service of the Promoter, Prize provider, manufacturer and/or supplier, and/or anyone involved in the provision or delivery of the Prize. These terms will be communicated to the Prize Winner prior to the handover of the Prize.
Prizes are subject to availability. The Promoter reserves the right to substitute any prize with a Prize of equal or greater value.
9.5 Prize Acceptance
Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes, aside from the exception listed in Clasue 9.6. The Prize cannot be used in conjunction with any other vouchers, offers, or discounts, including without limitation, any vouchers or offers from the Promoter or other Prize suppliers and/or third parties.
9.6 Cash Alternative Option
The Promoter may offer Prize Winners the option to choose between receiving the full Prize for the Competition or a cash alternative, as determined by the Promoter and reasonably equivalent to the Prize. The Prize Winner is under no obligation to accept the cash alternative. For the avoidance of doubt, the full Prize, as per the Competition’s details, will be awarded unless the cash alternative is accepted.
9.7 Specific Conditions for Vehicle Prizes
If the Prize awarded in a Competition is a vehicle, the following specific terms apply:
9.7.1 MOT Certification
- The Promoter guarantees that, unless specified otherwise, any vehicle Prize will be provided with a valid MOT certificate, where required by law.
9.7.2 Insurance Responsibility
- The Prize Winner is responsible for obtaining and maintaining adequate insurance coverage for the vehicle before operating it on public roads, in compliance with legal requirements.
9.7.3 Post-Delivery Responsibilities
- Upon delivery of the vehicle, all responsibilities pertaining to the Prize, including but not limited to its maintenance, operation, and compliance with all relevant laws and regulations, are transferred to the Prize Winner.
9.7.4 Exclusion of Vehicle/Road Tax
- Unless the vehicle is brand new, vehicle road tax (VED) associated with the Prize is not included and is the responsibility of the Prize Winner.
9.7.5 Operational Competence
- The Prize Winner must ensure they possess the necessary licenses, qualifications, knowledge, and experience to operate the vehicle in a safe and lawful manner.
9.7.6 Safety Equipment and Compliance
- The Prize Winner is solely responsible for acquiring and utilising appropriate safety equipment and clothing, such as helmets, boots, and gloves, when operating the vehicle. The Prize Winner must adhere to all safety requirements and wear the necessary protective gear during operation.
9.8 Conditions for Holiday or Event Prizes
When the Prize awarded is a holiday or event experience, the following specific terms are applicable:
9.8.1 Prize Details and Inclusions
- The specific details of the Prize, including the number of tickets, class of transport, type of carrier, and destination, will be as specified in the Prize description on the Website. The flexibility of dates for the Prize will depend on its nature; fixed-date events such as Grand Prix tickets will have predetermined dates, while more generic holiday prizes may offer date flexibility. The Prize will exclude certain dates as detailed on the Website.
- The Prize will not cover travel insurance, transfer costs to and from airports or stations, food and drink expenses, spending money, taxes, personal expenses, or any other items not expressly included in the Prize description.
- Any additional costs incurred beyond those explicitly included in the Prize are the responsibility of the Prize Winner. A cash supplement may be part of the Prize if stated on the Website, but this constitutes the limit of the Promoter’s financial liability.
9.8.2 Travel Requirements and Restrictions
- Winners are responsible for ensuring their availability to travel on the specified dates and for possessing valid passports, visas, and necessary travel documents for the designated holiday. This responsibility extends to any persons accompanying the Prize Winner.
- Travel dates, once confirmed and communicated to the travel agent, are final and cannot be altered. It is incumbent upon the Prize Winner to adhere to these dates and ensure all travel arrangements are in place.
9.9 Conditions of Cash Prizes
In the event of a cash Prize, the Promoter shall facilitate the transfer of the Prize amount directly into the bank account nominated by the Prize Winner.
If requested by the Promoter, the Prize Winner must provide satisfactory evidence substantiating their status as the sole or joint beneficiary of the specified bank account. Should the Prize Winner fail to provide such evidence within a period of fourteen (14) days from the Promoter's request, they will be deemed to have forfeited their right to claim the Prize. Consequently, this will result in the Prize Winner's disqualification from the Competition.
9.10 Forfeiture of Prizes
In circumstances where the Prize is forfeited, the Promoter retains the right to allocate the Prize to the next eligible Entrant. This selection will be made from among the correct entries received prior to the Competition's ending. Alternatively, in the case of an Instant Win Competition, the Promoter may at its discretion dispose of the Prize in a manner it deems appropriate. The Promoter shall bear no liability towards the original Prize Winner for the reallocation or disposal of the Prize under these conditions.
10. Storage
10.1 Prize Storage and Delivery Terms
In certain situations, the Promoter offers complimentary storage for the chosen Prize for a period of up to 30 (thirty) days following the notification to the Prize Winner. This provision is made to accommodate any logistical or personal constraints that the Prize Winner might face immediately after winning. Once this 30-day period elapses, arrangements will be made to deliver the Prize to the Prize Winner. However, should there be a necessity for the Prize to remain in storage beyond this 30-day window, the storage costs incurred beyond the initial 30 days will be borne by the Prize Winner. The Promoter will communicate any such reasonable storage costs, which must be settled by the Prize Winner prior to the delivery of the Prize.
11. Winners’ Personal Data
11.1 Consent for Promotional Activities
Subject to the Prize Winner’s explicit consent, the Promoter may invite the Prize Winner to participate in photo and video sessions. These sessions are aimed at capturing the Prize Winner’s celebratory moments for use in the Promoter’s promotional endeavors, notably in Public Relations and Marketing campaigns. This is an opportunity for Winners to share their experiences associated with the Competition, helping to foster a sense of community and engagement among current and prospective participants.
11.2 Usage of Entrant’s Personal Details
As part of the Entry process into a Competition, each Entrant will be asked to provide their consent for the use of their personal details. This includes the use of the Entrant’s name, address, photographs or other likenesses, and their participation in any reasonable publicity organised by the Promoter. Such usage is intended for promotional purposes without any additional compensation, except for reasonable travel expenses, which will be pre-approved in writing by the Promoter. It is crucial to note that every Entrant retains the right to withhold consent for the use of their contact details in such manners, ensuring their personal preferences and privacy are respected.
12. Limits of Liability
12.1 Disclaimer of Representations and Warranties
The Promoter explicitly clarifies that it neither makes nor gives any representations, warranties, or assurances of any kind, whether expressed in writing or implied, regarding the quality, suitability, or fitness for a particular purpose of any of the goods or services advertised, offered, or provided as Prizes in the Competitions. This exclusion applies except in instances involving liability for death or personal injury caused by the Promoter’s negligence, any fraudulent misrepresentations, or any events and circumstances that legally cannot be excluded or limited. Furthermore, the Promoter shall not be held liable for any loss or damage, whether direct, indirect, consequential (including economic losses), incurred by any person or property in connection with the arrangement for supply, or the actual supply, of any goods by any person to the Prize Winner(s), or in relation with the Competitions promoted by the Promoter.
12.2 Limitation of Liability to Prize Winners
The total maximum aggregate liability of the Promoter towards each Prize Winner is expressly limited to the total value of the Prize won by that Prize Winner. This limitation ensures a balanced and fair approach to addressing any potential claims or disputes arising from the participation in the Competitions.
12.3 Limitation of Liability to Entrants
For Entrants who do not emerge as Prize Winners, the total maximum aggregate liability of the Promoter is limited to the total amount that the Entrant has paid to enter Competitions within the first 6 (six) months of their participation. This provision serves as a measure to equitably cap the Promoter’s liability while acknowledging the Entrant’s investment in the Competitions.
12.4 Preservation of Statutory Rights
It is important to note that nothing in these Terms of Service shall be construed to restrict or prevent any claims made by the Entrants or Prize Winners to the extent that they are exercising their statutory rights. This clause ensures that the legal rights of all participants are preserved and respected in accordance with applicable laws.
12.5 Sole Remedy
If, for any reason, a Participant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is another entry in a Competition.
13. Third-Party Rights
13.1 Independence from Third Parties
It is important for participants to understand that the Competitions hosted by the Promoter are conducted independently. This means that these Competitions are not sponsored, endorsed, administered by, or associated with any social media platforms or other third parties. This includes, but is not limited to, platforms such as Facebook, Twitter, Instagram, or Google.
13.2 Participant Acknowledgement
Unless otherwise stated on a Competition webpage on the Website, each Competition on the Website is not sponsored, endorsed, or affiliated in any way with any advertising platform used in connection with the promotion of any Competition, including, without limitation, the Facebook platform owned and operated by Meta Platforms, Inc., Google LLC, Instagram, Inc., Pinterest, Inc., Reddit, Inc., Snap Inc., Twitter, Inc., and any of their respective parents, subsidiaries, and affiliates.
Any communication or interaction related to the Competitions, including the submission of any personal information, is exclusively between the Entrant and the Promoter. There should be no expectation of rights, recourse, or redress from any of these third-party entities in matters pertaining to the Competitions.
14. Validation
14.1 Winner Fairness
To uphold the highest standards of fairness and legitimacy, the Promoter implements several internal verification processes. These processes are essential to ensure adherence to the Promoter's commitment to fairness.
14.2 Prerequisites for Prize Award
- Account Validation: It is imperative that the Prize Winner holds a valid and compliant account on the Promoter's Website.
- Clearance of Obligations: The Promoter requires that any financial obligations or dues the Prize Winner owes to the Promoter must be settled in full prior to the Prize's release.
- Confirmation of Identity and Eligibility: You need to be 18 years or older to enter a Competition. The Prize Winner may be required to to successfully pass a verification check for age and/or identity and the Promoter may, on occasion and at its sole discretion, insist on receiving satisfactory documentary evidence to confirm the Prize Winner's identity. The delivery of the Prize may be contingent on the successful completion of this verification.
- It is important to note that the Promoter's verification process is limited to checks for age and identity. The Promoter does not conduct background checks or criminal record investigations, focusing solely on the eligibility criteria pertinent to the Competition.
14.3 Fraud Detection and Prevention
WARNING: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE ASSOCIATED WITH A COMPETITION OR UNDERMINE, OR ATTEMPT TO UNDERMINE, THE LEGITIMATE OPERATION OF A COMPETITION MAY BE A BREACH OF LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTER RESERVES THE RIGHT TO CLAIM AGAINST AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
- Right to Withhold Prize: In the pursuit of maintaining the integrity of the Competition, the Promoter reserves the right to withhold or retract a Prize if there is a reasonable suspicion of fraudulent activity. Examples of such fraudulent activities include, but are not limited to:

- Manipulation or tampering with the Entry process or the outcome of the Competition.

14.4 Delegation of Prize Collection
- Authorised Claim: Under special circumstances, the Promoter may, at its sole discretion, permit the Prize to be claimed by an authorised representative of the Prize Winner. This allowance is conditional upon the Promoter's satisfaction that the representative is acting under a legally recognised power of attorney ('PoA') or equivalent authorisation.
15. Account Security and Prohibited Activities
15.1 Maintaining Account Security
The integrity and security of participant accounts on the Promoter's Website are of utmost importance. Participants are responsible for maintaining the confidentiality and security of their account information, including usernames and passwords. It is crucial for each participant to take all necessary steps to secure their account against unauthorised access and use.
15.2 Participant Responsibilities

This may include, but is not limited to, account suspension, disqualification from current and future Competitions, and legal action.
- Reporting to Authorities: The Promoter reserves the right to report such activities to the relevant legal authorities and the police, and to seek restitution or damages for any loss or harm caused by these actions.
15.5 Acknowledgement by Participants
By creating an account and participating in a Competition(s), participants acknowledge their understanding of these security obligations and agree to abide by these terms, contributing to a safe and fair environment for all.
16. Force Majeure
16.1 Unforeseen Circumstances
In the event of unforeseen circumstances beyond the Promoter's reasonable control, including but not limited to natural disasters, pandemics, acts of God, war, terrorism, governmental regulations or orders, strikes, civil disorder, or other similar events, the Promoter reserves the right to modify, suspend, or cancel the Competitions. This clause is invoked in situations where these external factors materially impact the Promoter’s ability to initiate, conduct, or complete the Competitions as planned.
16.2 Participant Notification
Should such a Force Majeure event occur, the Promoter will make all reasonable efforts to notify participants as soon as possible. This notification will detail the nature of the event, its impact on the Competition, and any consequent actions taken by the Promoter.
16.3 Responsibility and Liability
Under such Force Majeure circumstances, the Promoter will not be held responsible or liable for any failure to perform, or delay in performance of, any of their obligations under the Competition Terms of Service that is caused by such events. The Promoter’s primary concern in such situations is the safety, fairness, and well-being of all participants and staff involved.
17. General Terms of Service
17.1 Enforcement of Terms
The Promoter's failure or delay in enforcing any provision of these Terms of Service at any point does not constitute a waiver of their right to enforce such provisions in the future.
17.2 Hyperlinks and Third-Party Websites
The Website may include hyperlinks to websites operated by entities other than the Promoter. These links are provided for convenience and informational purposes only. The Promoter is not responsible for the content, privacy practices, or any other aspect of these external websites. The inclusion of any hyperlinks to such websites does not imply endorsement, partnership, or association with their operators. Participants must exercise caution when accessing these external sites and ensure protection against viruses or other cyber threats. Creating a hyperlink to the Website requires the Promoter’s prior written consent.
17.3 Validity of Provisions
In the event that any provision or part of a provision within these Terms of Service is determined to be void or unenforceable by a court of competent jurisdiction, this will affect only that specific provision or part, leaving the remainder of the Terms of Service intact and enforceable.
17.4 Assignment and Transfer
Participants are prohibited from assigning or transferring any of their rights or obligations under these Terms of Service, either in whole or in part. Violation of this condition may lead to suspension or termination of account usage, participation in the Competition, and access to the Website. Conversely, the Promoter reserves the right to assign its rights and obligations, in whole or in part, to any third party at its sole discretion. In the case of a merger, reorganisation, or sale of assets or equity, these Terms of Service will continue to be binding to the Promoter’s successors and permitted assigns.
17.5 Entire Agreement
These Terms of Service represent the entire agreement between the participant and the Promoter, superseding any prior or contemporaneous agreements or terms related to the subject matter of these Terms of Service.
17.6 Rights of Third Parties
Non-parties to these Terms of Service have no rights under the Contracts (Rights of Third Parties) Act 1999, or any similar legislation, to enforce any provision of these Terms of Service.
17.7 Payments
All payment transactions made through our website are encrypted and securely processed. It is the responsibility of our participants to ensure that their PayPal or Stripe account information is current and accurate to avoid any issues with transaction processing. We encourage participants to meticulously review all transaction details for accuracy before confirming their payment, as inaccuracies in transaction data can lead to complications in the processing of their Entries.
It is important to note that the Promoter's role in the payment process is limited to facilitating these transactions. We do not store, nor do we have direct access to, the financial details of participants used in PayPal or Stripe transactions. Should any queries or issues arise related to payment transactions, participants are advised to contact PayPal or Stripe directly for assistance and resolution.
18. Governance and Jurisdiction
18.1 Application of Law
- All Competitions organised by the Promoter are governed and construed in accordance with the laws of England & Wales.
18.2 Dispute Resolution
- In the event of any disputes, controversies, or claims arising out of or in connection with a Competition, these matters will be exclusively subject to the jurisdiction of the courts of England. This clause applies to all aspects of the Competitions, including but not limited to, eligibility, Prize awarding, and participant conduct.
- By entering the Competitions, participants agree to submit to the exclusive jurisdiction of these courts for the resolution of any such disputes. This means that any legal action or proceedings arising out of or in connection with the activities of the Competitions must be brought in these courts.
18.3 Binding Nature of Jurisdiction
- The choice of jurisdiction is binding on all participants. This means that participants waive any right to challenge the jurisdiction or venue, or to seek to have the case heard in another jurisdiction.
18.4 Amendements/Revisions
These Terms of Service may only be amended and/or revised in writing by the Promoter (including by publishing such revisions on the Website). The Promoter may amend these Terms of Service at any time by posting the amended Terms of Service on the Website, and you agree that you will be bound by any changes to these Terms of Service from the date they are published on the Website. If, however, you have already entered a Competition, the changes will not apply to any Entries that you have already submitted, but they will apply to any future Entries that you submit after the date on which the change becomes effective.
19. Mobile Terms of Service
The Go4 Competitions Ltd mobile message service (the "Mobile Service") is operated by Go4 Competitions Ltd (“Go4 Competitions Ltd”, “we”, or “us”). Your use of the Mobile Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Mobile Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Go4 Competitions Ltd’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Go4 Competitions Ltd through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Mobile Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Go4 Competitions Ltd. Your participation in this program is completely voluntary.
We do not charge for the Mobile Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Mobile Service at any time. Text the single keyword command STOP to Go4 UK or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Go4 Competitions Ltd mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
For Mobile Service support or assistance, text HELP to Go4 UK or email [email protected].
We may change any short code or telephone number we use to operate the Mobile Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Mobile Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Service.
